HR Compliance Health Check for UAE SMEs: What to Review
What a UAE HR compliance audit should cover: contracts, WPS payroll, visas and permits, policies, leave, Emiratisation, health and safety, and HR records.

An HR compliance health check for a UAE SME reviews whether your employment contracts, payroll, visas and work permits, workplace policies, leave practices, Emiratisation obligations, health and safety arrangements and HR records meet the requirements of Federal Decree-Law No. 33 of 2021 and MOHRE regulations. The goal is to identify gaps before they turn into fines, labour complaints or blocked work permits. A good review ends with a prioritised action plan, not just a list of problems.
Why should SMEs run an HR compliance audit?
Small and mid-sized businesses rarely set out to break labour rules. Gaps appear gradually: a contract not updated after a promotion, a policy copied from another company, a former employee whose permit was never cancelled. Each one is minor on its own, but together they create real exposure.
A health check gives owners and managers a clear picture of where the business stands. It is especially useful:
- Before raising investment or selling the business, when buyers will run their own due diligence
- After a period of rapid hiring
- When moving from a founder-led HR model to a dedicated HR function
- After significant changes in labour regulations or MOHRE procedures
What should an HR compliance audit cover?
Employment contracts
- Every employee has a MOHRE-registered contract that reflects their current role and wage.
- Contract terms on probation, notice, working hours and leave stay within legal limits.
- Supplementary contracts or offer letters do not conflict with the MOHRE contract.
- Non-compete and confidentiality clauses are reasonable and properly drafted.
Visas and work permits
- Every person working for the company holds a valid work permit linked to your establishment.
- Residence visas and Emirates IDs are current, with renewals tracked ahead of expiry.
- Part-time, temporary or freelance workers are engaged on the correct permit type.
- Employees who have left have had their work permits and visas cancelled.
Payroll and WPS
- Salaries are paid through the Wage Protection System on the due date.
- Payroll amounts match registered contracts.
- Deductions are lawful and documented.
- Overtime, leave pay and gratuity are calculated correctly.
Internal policies and regulations
The labour law expects employers to set clear internal rules, including disciplinary procedures. A health check should confirm that:
- An employee handbook or internal regulations exist and are current.
- Disciplinary and grievance procedures are written, fair and followed in practice.
- Policies on anti-discrimination, harassment and equal treatment reflect the law.
- Employees have acknowledged receipt of key policies.
Working hours and leave
- Working hours, rest periods and overtime are recorded and comply with the law, including reduced hours during Ramadan where applicable.
- Annual leave, sick leave, parental leave and other statutory leave are granted and paid correctly.
- Leave balances are accurate and carried forward or encashed in line with the law and contracts.
Emiratisation
Companies that meet the relevant size or sector criteria have Emiratisation targets under MOHRE’s programme. An audit should check whether the company is in scope, whether targets are being met, and whether UAE national employees are registered with the relevant pension authority. The criteria have been extended in recent years, so confirm your current position with MOHRE or your adviser.
Health, safety and welfare
- The workplace has appropriate health and safety measures for the type of work.
- Outdoor workers are protected by the midday work break during the summer months.
- Health insurance is in place for every employee as required in the relevant emirate.
- Any employer-provided accommodation meets applicable standards.
HR records and data
- Personnel files are complete, including contracts, ID copies, qualifications and performance records.
- Records are retained for the period required by law.
- Employee personal data is stored securely and accessed only by authorised people.
How is an HR health check carried out?
A practical audit usually follows four stages:
- Scoping. Agree which entities, locations and employee groups are covered.
- Document and data review. Examine contracts, policies, payroll reports, MOHRE and immigration records and a sample of employee files.
- Interviews. Speak with managers, HR and payroll staff to understand how processes work in practice.
- Report and action plan. Rate each finding by risk and recommend specific, time-bound actions.
The most useful reports rank findings so leaders know what to fix this week, this quarter and this year.
What are the most common findings?
From the reviews we carry out for SME clients, recurring issues include:
- Salary changes agreed by email but never reflected in MOHRE contracts.
- Missing or outdated employee handbooks.
- Disciplinary actions taken without a documented procedure.
- Inconsistent calculation of end-of-service gratuity.
- Staff working on visas sponsored by another entity or under the wrong permit type.
- Expired documents for employees who are still on the payroll.
None of these is unusual, and all can be fixed with the right plan.
What happens after the audit?
The real value comes from closing the gaps. Some actions, such as writing an employee handbook or fixing contract templates, are one-off projects that our HR policies and compliance audit service covers. Others, such as keeping records current, are better suited to ongoing HR support.
Many clients follow the audit with an HR retainership, so a dedicated team keeps contracts, policies and records current month after month. Businesses that need senior guidance on structure, reward or culture often choose our HR outsourcing and advisory service, which provides fractional CHRO support.
